Price Heneveld Names Jeffrey S. Kapteyn as Its Newest Partner

Price, Heneveld, Cooper, DeWitt & Litton, LLP has named Jeffrey S. Kapteyn as its newest partner with effect from January 1, 2009.

Mr. Kapteyn is a licensed patent attorney with substantial experience procuring and enforcing patents for mechanical and electromechanical inventions. Mr. Kapteyn also registers and enforces trademarks. Prior to joining Price Heneveld®, he worked as an engineer for Hughes Aircraft Corporation, where he analyzed and designed satellite components and systems. While attending law school, Mr. Kapteyn interned at the U.S. Department of Justice, where he was involved in litigation relating to government contracts. He earned a J.D. from The George Washington University, a M.S. degree in aeronautics and astronautics from Stanford University, and a B.S. degree in mechanical engineering from Michigan Technological University. Registered to practice before the U.S. Patent and Trademark Office, he also is admitted to the State Bar of Michigan and is a member of the American Intellectual Property Law Association, the Grand Rapids Bar Association, and Licensing Executives Society.

Price Heneveld Welcomes New Attorney Paul Rodriguez

Grand Rapids, Michigan – Price, Heneveld, Cooper, DeWitt & Litton, LLP, the leading intellectual property law firm in West Michigan, is pleased to announce that attorney Paul A. Rodriguez has joined the firm.

Prior to joining Price Heneveld, Rodriguez, an associate, gained valuable experience as a law clerk at a Chicago law firm. He also worked as a test engineer/conductor at Moog Inc.’s Chatsworth Operations in Chatsworth, CA.

Rodriguez received a B.S. degree in mechanical engineering from the University of Michigan in 2004 and a J.D. degree from DePaul University College of Law in Chicago in 2008 where he earned a certificate in intellectual property in patent law. As an undergraduate student, he was a member of the American Society of Mechanical Engineers and, as a law student, he was a member of the Intellectual Property Law Society and the Intellectual Property Legal Writing Program.

He is currently a member of the American Intellectual Property Law Association and the Grand Rapids Bar Association (Intellectual Property  and Young Lawyers Sections).

Lacks Prevails Before Court of Appeals for the Federal Circuit in Patent Dispute with McKechnie and Hayes

Price Heneveld is pleased to announce a decision of the Court of Appeals for the Federal Circuit in favor of its client, Lacks Industries. Lacks owns a patent covering methods relating to cladded wheel assemblies for automobiles. On November 21, 2008, the Federal Circuit reversed the district court’s decision on summary judgment in favor of Defendants McKechnie and Hayes Wheel and remanded the case for further proceedings. The Federal Circuit held that the Defendants had not shown that Lacks’ patent was invalid by clear and convincing evidence, but rather that there were material facts in dispute regarding this legal conclusion. If the district court does not find invalidity on remand, a determination of damages Lacks suffered as a result of the infringement of Lacks’ patent by Defendants is to follow.

Price Heneveld Wins Case for Veteran Medical Products, Inc., Tillman Industries and Three Individuals

April 18, 2008

Price Heneveld recently obtained a favorable jury verdict in favor of clients Veteran Medical Products, Inc., Tillman Industries, Patrick Eddy, Joseph Szyperski, and Ryan Heidenfeld (collectively “Veteran”). The dispute involved Bionix Development Corporation’s and its president Dr. Andrew Milligan’s (collectively “Bionix”) allegation of design patent infringement and trade secret misappropriation against Veteran. Specifically, as to the later count, Bionix alleged that Veteran had misappropriated its technical and business information. Veteran denied these allegations and countered by asserting claims of unfair competition against Bionix. In particular, Veteran alleged that Bionix's design patent infringement claim was brought in bad faith and was objectively baseless. At the summary judgment hearing, Bionix withdrew its claim of design patent infringement, and the Court dismissed this count on October 18, 2007.

On March 13, 2008, the Court also dismissed Bionix’s claim of trade secret misappropriation for its technical information. The remaining issues for trial were whether Bionix had competed unfairly in the marketplace through its baseless allegations, and whether Veteran was liable for trade secret misappropriation of Bionix’s business information. On April 18, 2008, after a five-day jury trial in the Western District of Michigan, an eight-member jury found that Veteran was not liable for trade secret misappropriation. The jury also returned a verdict that Bionix had committed unfair competition and awarded Veteran $199,000 for its claim against Bionix.

Price Heneveld Obtains Victory for Perrigo Company in Patent Infringement Suit Against McNeil-PPC, Merck, and Johnson & Johnson-Merck Consumer Pharmaceuticals

Price Heneveld secured a significant victory for client Perrigo Company (Perrigo), a leading global healthcare supplier and the world’s largest manufacturer of over-the-counter pharmaceutical products for the store brand market.

On April 14, 2008, the U.S. Court of Appeals for the Federal Circuit affirmed the U.S. District Court for the Southern District of New York’s holding of invalidity of the plaintiffs’ patent on the formulation for the heartburn drug Pepcid® Complete. The case centered on plaintiffs’ allegations of patent infringement based on Perrigo filing an Abbreviated New Drug Application for its Famotidine Complete product. Price Heneveld attorneys argued that the patent was invalid as obvious, and the Southern District of New York and Federal Circuit Court of Appeals agreed.
