Price Heneveld Wins Case for Veteran Medical Products, Inc., Tillman Industries and Three Individuals

Price Heneveld recently obtained a favorable jury verdict in favor of clients Veteran Medical Products, Inc., Tillman Industries, Patrick Eddy, Joseph Szyperski, and Ryan Heidenfeld (collectively “Veteran”). The dispute involved Bionix Development Corporation’s and its president Dr. Andrew Milligan’s (collectively “Bionix”) allegation of design patent infringement and trade secret misappropriation against Veteran. Specifically, as to the later count, Bionix alleged that Veteran had misappropriated its technical and business information. Veteran denied these allegations and countered by asserting claims of unfair competition against Bionix. In particular, Veteran alleged that Bionix's design patent infringement claim was brought in bad faith and was objectively baseless. At the summary judgment hearing, Bionix withdrew its claim of design patent infringement, and the Court dismissed this count on October 18, 2007.
On March 13, 2008, the Court also dismissed Bionix’s claim of trade secret misappropriation for its technical information. The remaining issues for trial were whether Bionix had competed unfairly in the marketplace through its baseless allegations, and whether Veteran was liable for trade secret misappropriation of Bionix’s business information. On April 18, 2008, after a five-day jury trial in the Western District of Michigan, an eight-member jury found that Veteran was not liable for trade secret misappropriation. The jury also returned a verdict that Bionix had committed unfair competition and awarded Veteran $199,000 for its claim against Bionix.
Price Heneveld Obtains Victory for Perrigo Company in Patent Infringement Suit Against McNeil-PPC, Merck, and Johnson & Johnson-Merck Consumer Pharmaceuticals

Price Heneveld secured a significant victory for client Perrigo Company (Perrigo), a leading global healthcare supplier and the world’s largest manufacturer of over-the-counter pharmaceutical products for the store brand market.
On April 14, 2008, the U.S. Court of Appeals for the Federal Circuit affirmed the U.S. District Court for the Southern District of New York’s holding of invalidity of the plaintiffs’ patent on the formulation for the heartburn drug Pepcid® Complete. The case centered on plaintiffs’ allegations of patent infringement based on Perrigo filing an Abbreviated New Drug Application for its Famotidine Complete product. Price Heneveld attorneys argued that the patent was invalid as obvious, and the Southern District of New York and Federal Circuit Court of Appeals agreed.
